Ken Marsh is receiving no compensation from the ones that wrongfully incarcerated him. It has not been an easy adjustment for them. Donations are greatfully accepted, and genuinely appreciated. Ken Marsh has had twenty one years to thoughtfully consider what these first days of freedom might be like. Including the possibility some people might try to play down the importance of this historic event. Even, that some people might be uninformed of the painstaking detailed analysis undertaken by the forensic scientists who establish and give their sworn testimony to Ken Marsh's innocense. For anyone to say today. that the Habeas Petition and Traverse does not establish his innocence, is simply uninformed. Ken Marsh was prosecuted during a wave of child abuse prosecutions during the 1980's, many of which were investigated by grand juries and later found to be wrong. Any Mother, Father or other care giver who has the ill-fortune of a child being accidentally injured while in their care could be faced with the same fallacious charge. A child who turns over their tri-cycle, falls from a skate board, or simply slips in a bath tub and suffers a severe injury or death, provided fodder far zealots to claim that it must have been child abuse. The law, however, requires that innocent explanations be eliminated through differential analysis before you can claim an injury is inflicted by another. To do so without differential analysis is both fallacious logic and a terrible mar to our system of justice. Phillip Buell fell from a sofa and cracked his head on a brick fireplace hearth, His existing medical condition contributed to the speed by which his brain swelled. This is what the evidence establishes. Phillip Buell was an easy bruiser and rescue efforts left bruises on Phillip that were placed there by doctors and paramedics trying to save his life. This is what the evidence establishes. Kenneth Marsh is and was a kind and gentle man who simply never possessed the propensity to injure Philip Buell. This is what the evidence establishes. As I sit here and prepare to write this I realize there are an infinite number of places I could start however I'll start from where I am right now. In prison in a cold cell where I have been for nearly 20 years. Sentenced to Life in Prison for a crime I did not commit. A crime that never took place. I was only 28 years old at the time. How can this happen, how did it happen to me. The more I hear, and the more I read, I see it happens more than you may think. Even though I did not receive a death sentence by the Judge or Jury my life here in Prison is a death sentence itself. A long slow emotionally painful death sentence. The one thing here that I am allowed that those on death row are not is Time. Time to try to prove I am truly an innocent man. Indeed the execution of the guilty is unpleasant. But not nearly as the incarceration/execution of the innocent. Research reveals that as of January 2002 there were 316 people in the United States released from Prison after it was proven that they were in fact innocent of the crime they were convicted of. Twenty-one of those in California. Fifty-eight of the three hundred sixteen were sentenced to death, seventy-eight of them sentenced to Life in Prison. One hundred and ten were exonerated through DNA testing. The remainder through confessions by the actual culprits, the victims being found alive, recantations by critical witnesses or by the discovery of missing or suppressed evidence. These are disturbing statistics and I am amongst the innocent that still sit and wait for Justice to be served. I was convicted of killing a baby (Phillip) who I loved dearly. This little boy was a joy to all that came into his short life. He was a good boy and did nothing to ever deserve to be punished for. Prior to his death Phillip was very ill. We would take him to the doctors for frequent illnesses. During his illness we became fearful that the hospital was to far away. So Brenda and myself moved to an area closer to the hospital that cared for him. We arranged to work different schedules so that someone that we trusted was always with him. This was something we choose to do and neither of us resented it. We were scared for his safety. Little did we know that whomever might have been with him would have been accused and convicted of killing him when he fell. I was watching the kids that day; I was as Brenda very protective and watchful over his care. However I choose to make a fatal error when I walked out of the room to get a vacuum and left him unattended. Only to return seconds later to find him unconscious on the floor. It was the most horrifying experience for anyone to have to go through, finding Phillip like that and feeling so helpless was like a knife to my heart. I loved Phillip and watched him grow from birth to death. Then to be accused and punished for his death was the ultimate death for my soul. How could this be, how could this happen. His family knew it was not true, Phillips mother begged the Court to look at the case and see it wasn't true, she begged the Coroner to find out why he was so sick prior to death. The Police knew it was not true yet the doctors, the very doctors that were caring for him during his many illnesses insisted that I be arrested that I was a murderer. We were all in shock, in mourning and I would be paying the ultimate price for loving him. What happened on that fatal day was an accident, an accident that turned into my life nightmare. This tragedy may have been avoided if the doctors had paid attention before and after his fall, and Phillip might still be alive. After many years of struggling for experts and giving her life to Truth and Justice Brenda may finally be able to allow Phillip to rest in peace and begin her life outside of living his death. She has made it her life mission to support and fight for Justice, I am blessed to have a living Angel on my side. Without her I may sit here till the end of my life being accused of a crime I am not only incapable of but did not commit. I am hoping that out of our suffering others that may be saved. We always say that there must be a reason behind all of this, so we just pray that in the end it will have been for a better system of "Justice for All". I am Innocent. Ken Marsh
